Adding Video To Your Web Site Can Help Attract New Clients

In the age of the Internet, consumers expect immediate gratification, answers at the click of a button and engaging visuals to capture their attention. As a professional photographer, the demands of your potential clients are no different.

Photographers from all walks of life have been adding video components to their Web sites in an effort to attract new clients, showcase their creativity and create an emotional connection before ever speaking to or meeting with them directly. But, interestingly, only about two percent of the world's professional photographers have jumped aboard the video train.

Many of these are the photographers who are on the cutting edge or at the top of their field, and, as a result, they are leading the industry. For everyone else, this trend seems to take some consideration either because of the technical hurdles you'd have to overcome or because you might be afraid of breaking the bank.

The truth is there are many ways to incorporate video on your Web site and you don't need the technical know-how or a big budget to accomplish this goal. In fact, most new computer operating systems are built to handle video capture and viewing, and if they do not also include a camera for creating the video, you can easily purchase the hardware and software you need at an affordable price. As a result, the end product can be as simplistic and homemade or as professional and flashy as you'd like it to be.

Attracting potential clients through video
Before we get into the nitty-gritty of creating a video and uploading it to your site, it's important to understand how videos can benefit your business. Photographers are using videos to explain who they are and what a potential client's experience will be like, provide a "behind-the-scenes" look at how they work, and translate their creative ideas into a visual story.

The trend toward photographers using video on their Web sites began with people putting their images to motion by creating a virtual video with audio, moving images and graphics to help tell a story. It was only logical that the wedding industry embraced this trend on the heels of the advent of sites like YouTube.com. Video is now an influential medium for communication and consumers have grown accustomed to hitting "play" and getting all the information they need.

In today's globalized economy, people are not only searching for products local to their area, but they want the best and, if the price is right, they'll go to the other side of the country (and sometimes the world) to get it.

People are also less patient and tend to have less time, so watching three videos to see if they like a photographer instead of scheduling three meetings to evaluate their work is a value add, regardless of whether you are a bride or a busy art buyer. Videos are the perfect solution to creating that emotional connection from afar, and it's not just wedding photographers who have discovered this.

Now, more and more commercial photographers and photojournalists are realizing the benefits of using videos on their Web sites. Photojournalists are using them to help bring their stories to life and commercial photographers are using them to share their creative vision or to provide a further understanding of how they work and what makes them tick.

In fact, videos have proven particularly useful for the commercial photographers, whose job opportunities typically hinge on their ability to work well with an art director. Videos streamline the hiring process, allow art directors to determine if a photographer's style is in keeping with what they are looking for and how well their personalities and working styles might fit with the client's.

What kinds of videos are right for your business?
Much like the three uses for video I highlighted earlier, there are three different kinds of videos that tend to correspond to those purposes, and most photographers start with the easiest (and least expensive) version and work their way up the ranks.

Slide show set to music
For starters, most photographers creep into the video world by setting their still images to music and creating a slide show to help tell their story and showcase their work. This involves adding motion to the site -- while not necessarily introducing video. Examples of this kind of video, in the wedding and photojournalism industries, can be viewed on CHRIS+LYNN's Web site and the Curse of the Black Gold Web site.

[Unfortunately, QuickTime will be needed for viewing this last site. Connected Photographer doesn't recommend QuickTime for video both because you have to download the entire video to view, as compared to Flash streaming video, and because the QuickTime intall download from Apple often comes with other, less savory payloads that will install themselves onto your computer. -Ed.]

Bio videos
The next logical step is to create a video that talks about who you are as a photographer and how you prefer to work with a client. These bios, if you will, can be shot on a Web cam or any of the latest and greatest video technologies on the market, and editing isn't always necessary.

The frequency of real-time videos being posted on the Web has altered people's expectations in terms of video quality, so as long as you have good lighting and speak clearly, the outcome will likely be acceptable. In fact, an unedited video can sometimes help your personality shine through, which makes it appear more endearing and natural. That being said, however, it is important to note that while you can develop online videos for free or for very little money, it is essential that you always put your best face forward. There's nothing wrong with being quirky and fun, but regardless of what kind of video you choose for your site or how you create it, it's crucial that its quality reflects the brand you want to portray.

Behind the scenes
That brings me to the last style of video photographers tend to use. This is typically a behind-the-scenes look at how a photographer works with a client and what sparks his or her creative vision. It may incorporate parts of the other two videos I mentioned, but is typically longer and of higher quality, so as to present the photographer in the best light possible.

Again, you don't have to spend a lot on a project of this nature, but when photographers decide to invest in videos on their Web sites, this tends to be the product they choose. An example of one of these videos can be viewed on John Griffin's Web site, or you can see how one photographer has incorporated all three types of videos on Garret Nudd's Web site. Unfortunately, Nudd's site tends to require you to wait until everything loads to begin telling you anything, a design that's not particularly recommended.

What factors do I need to consider before starting a video project?
Once you have decided to incorporate video into your Web site, the next thing you need to do is ensure that your current site can support it and, if it can, how you want the video to be viewed.

Some Web hosting sites simply do not allow you to upload videos. If that is the case with your site, that's a deal breaker and you'll have to shop around for a new host (or just host the video portion of your site with a video-friendly service).

Similarly, you need to find out whether or not your Internet service provider (ISP) can support the bandwidth you would be using with a video and, if so, how much it will cost you each month. You want to be sure that the people who visit your site have a quality experience, so if you're hosting your site at a place that is not set up to deliver data quickly and efficiently, you may need to look into a new host or consider the alternatives.

One alternative to placing your video on your own site is hosting it for free on another Web site, such as YouTube, CutFrame.tv (now part of Photography Mentor) or Blip.tv. You can use the embed code to put those videos right on your site, but it will have the host company's logo on it. Depending on what you are trying to achieve, having someone else's branding on your video may or may not work. Again, it all comes back to how you want to portray your brand.

Once you get past that decision, you need to determine how you want to encode the video, if you have the knowledge to do this yourself, and whether or not you want the video to be a streaming or progressive download.

The most common solution is to place your video on the host server and have it play back on the viewer's computer as the bandwidth allows. In this case, which is called a progressive download, people can pause the video to allow it to buffer, meaning that if they have a slow connection they can wait and then experience a clean playback at their leisure.

With streaming video, your video is sent to the viewer's computer only as they watch it, so if they have a slow connection it will be jumpy. This is the future of video playback but, unfortunately, for many people, this still does not deliver an acceptable experience.

The final thing to consider is what tools people will need to watch your video. You may be creating your video on a Mac, in which case it may seem to be a logical decision to post your video in QuickTime. However, you need to realize that people who are using a PC may not have a QuickTime player. What is most common and is used by the likes of YouTube is Flash video. The Flash Player is able to play back most videos and more than 98 percent of computers with Internet browsers have Flash Player installed.

You can also consider providing an embed code, which will allow people to upload your video to their own sites and blogs, and ultimately share it with others. Viral marketing is a good thing, and I would highly encourage this action.

Getting started
I understand that this is a lot of information to digest and that the process probably seems even more daunting after reading all of these options. However, it's not nearly as difficult as it seems and you can probably sort through your fears by making a quick call to a video savvy friend or your Web site provider. Many of the leading photography Web site companies can help you add video to your site without a lot of hassle or confusion.

The next step would be to review some other photographers' videos and see what the competition is up to. There are an array of photographer videos online, and they all range in length, approach, and quality. Once you've fully researched your options, you'll be well on your way to standing out in a sea of professionals and finding new clients with a greater appreciation -- and understanding -- of your work.

Crafting a Marketing Strategy

Photographers traditionally search for ways to let the world know they are creative folks, and then market themselves using the same old methods. It’s time to change the way you think. Now is the time to develop a new, creative and effective marketing strategy for your photography business.

Your marketing has to be innovative, informative, creative and above all, interesting. It’s about presenting yourself in an honest, simple to understand, positive manner that the client can relate to and be comfortable with. And most importantly, it means presenting spectacular images. After all, that’s what your prospective clients are seeking - amazing photography.

Who are you?

Understand who you are as a business first. Then determine who buys what you want to do. Your marketing strategy will follow. Once you identify who you are, make it your marketing message, slogan or tagline. This should be a brief description about what you do: We Photograph People; Digital Food for Menus; Auto Racing the World Over. Whatever you decide upon, it should be a straightforward reflection of you. Your tagline should be concise and consistent with what you are selling.

Who do you sell to?

Now that you have identified who you are, you need to determine who you are selling to. This is best done on paper — a successful marketing strategy should only be a single page. This list of potential clients, whether self-generated or purchased, is your target market. Do some research; find out all you can about the prospective clients and formulate a database. Don’t overwhelm yourself; keep the lists small and manageable. A list of about 25 prospects per list is a good number to begin with.

The USP

Establish your Unique Selling Proposition. Simply put, what is unique about your business? Use this uniqueness to position your business in the market. It is the foundation of your brand. The USP is a time-tested and effective strategy that all businesses use. Look at other industries; what do their tag lines suggest? Look at ads in magazines; see how businesses present themselves. Use these ideas as the building blocks upon which you will sell your own unique qualities and talents.

Your portfolio

When you are choosing images, find unique images that will separate you from the rest of the crowd. It is difficult look at your own work objectively, so ask for help from friends, a portfolio coach or anyone that might be able to assist you. And be sure to show your prospective clients images that talk about you, not what you think they want to see. Accept your uniqueness, embrace it and be as creative as you can be.

Contact materials

Look at your contact materials. They should be professionally designed and reflect the quality product you are delivering. You are marketing to designers and art directors, which means your contact materials need to be professional and creative.

Your marketing calendar

After you have pieced this all together, develop a calendar for the implementation of your marketing strategy. Will you market every quarter? Every month? Who knows what time is best? That is up to you to decide. One photographer did a mailing to 50 art directors every Friday for two months — she was the talk of the town. Decide what you are trying to say, and say it as effectively as possible.

Be committed to the image/brand you are presenting. Be committed to your marketing message. And be committed to your strategy.

Here’s a brief check list:

  1. Who am I? (Marketing message)
  2. How am I unique?
  3. Who do I want to do work for?
  4. How will I show them my work?
  5. Can my contact materials be better?
  6. Are these the most creative images I can show?
  7. Who can I get some unbiased help from?
  8. How often am I going to send out?
  9. How can I integrate multiple components for a common message?
  10. Develop your marketing calendar.
  11. Think positively and be relaxed.
  12. Double check everything.
  13. Look up the word serendipity in the dictionary.
  14. Stop planning already and do it!

You can’t stop marketing. It must be a part of your weekly routine. All of this work can be accomplished in just a few days per month. It isn’t overly complicated; it just requires your commitment to change. “That’s the way we have always done it,” is a dangerous strategy. Don’t be afraid to change.

Marketing Your Stock Directly to Buyers

It’s becoming increasingly difficult to make a reasonable amount of money from stock sales. There are still some success stories but the explosion of inventory and new sources for stock imagery, and the resulting downward price pressure all present significant challenges for photographers.

Some photographers decide to market their stock images themselves. This can have many benefits. It removes the “gatekeeper” aspect of stock agencies that may not want your work because they already have similar inventory. It’s also a chance for you to make your stock stand out from the crowd. And it opens up the possibility of much greater revenue. But marketing your own stock requires a substantial commitment in both time and resources.

There are many things to consider when deciding to market your own stock. The focus of this article is on marketing, so it assumes that if you want to market your stock directly you’ve already considered the following:

– Whether to use a hosted, turnkey service (such as IPN Stock, PhotoShelter, Digital Railroad, PhotoStockPlus) or build your own stock photo site.

– That you need distinctive, high-quality images that are significantly different from what buyers can find at the dozens of other common sources for stock.

– You are committed to spending a specific amount of your time and money in preparing and marketing your stock images.

The most difficult and expensive part of any stock business is getting your work in front of interested and qualified buyers. To give yourself the greatest chance of success, you should:

Focus on a Specific Market
It’s very difficult to compete head on with the big stock agencies. It’s expensive to address all possible photo buyers as they do, and your relative lack of inventory means that a lot of your marketing effort will be wasted. Your best chance of success is to focus on a specific set of buyers. Oftentimes, the work you do will dictate what that market is. If you shoot outdoors adventure images then your market is outdoor equipment companies and outdoor magazines. Do you have a lot of images from a specific geographic region? Focus on travel magazines and travel companies. The more tightly you can define your market, the easier and more cost-effectively you can address them.


Create a Distinctive Service
Many photographers offer stock for licensing on a “what the hell” basis. Somewhere on their portfolio site it says “Stock” where visitors can see some of the photographer’s most popular images. This is very different than making a proactive effort to market stock. Having a few dozen images on your site that you call stock is not something that will get the attention of buyers. Give your stock offering a sub-brand or its own brand. Make it clear that stock is a serious business to you. Clients can tell the difference.

Articulate Your Difference
Why should someone license an image from you? What is special about your images or your service? There is a lot of “noise” in the stock photo market. What is your brand for stock and what distinguishes it from the competition?

Market Consistently and Use a Variety of Channels
How will you get the attention of art buyers? Most hosted stock photo services attempt to attract photo buyers to their sites. But if you’re serious about getting stock sales you’ll need to drive traffic to your site yourself. Email blasts, postcards and booklets are just some of the ways you need to promote your stock offering. If your work is around a very specific subject (i.e. gambling, horses, rock climbing, jazz musicians) then Google AdWords might be a good way to attract traffic. The key is to be consistent. It often takes repeated exposure to a brand before a buyer will investigate. And photo buyers have different needs over time. The only way to ensure that you hit them at the time they are looking for work like yours is to always be out there.

Remember, buyers aren’t looking for images. They are looking for a service that provides the images they need. They want to deal with an organization that looks to be efficient and professional.

Marketing you own stock can be rewarding both creatively and financially. But it requires creating a brand that photo buyers recognize as targeted and professional. It also means making a commitment to put in the time, and resources to market your stock consistently and effectively.

Protecting Your Work: How and Why

The thing about copyright is that it’s your right. Hence “copy” and “right.” You have been given a limited monopoly over your creative endeavors to give you the incentive to create more. After you’re gone, and then after 75 years, your work belongs to your family or estate, and they can continue to benefit from your genius. Later, it becomes wholly owned by the public, and anyone can do whatever they want with your endeavors.

I think this is pretty great. I have been given the incentive to be a photographer. And I own my work. I can recall with great detail the environment surrounding most all of the photos I’ve made. Often I can recall the weather, the challenges of the client, the lighting setup, and who was on that shoot, whether colleagues or assistants. That means the shoot is a piece of me, and I feel protective about these little pieces of me and how someone might use them.

It’s the Principle of the Thing for Me

Don't confuse my incentive to be a photographer with greed or anything of the sort. I’d make images without being paid—although it’s work, it’s definitely not a job. However, when someone wants to exploit my work—pieces of me—for their own gain, I expect to be compensated for their use of my work.

For most editorial magazines, if they have 30 pages of advertising and 30 pages of editorial content, it’s those 30 editorial pages that the subscriber/reader wants to see. They’ve agreed to page through the 30 pages of ads because the value of the editorial content is enough for them to do so. In some cases, such as a fall fashion magazine or an annual automotive magazine with the next years’ line of cars, the ads may be a draw; however, these circumstances are the exception rather than the rule. So, if I have contributed a full-page image from an assignment, I have directly contributed to the value of the publication, and thus I should be compensated. If the magazine sells ad space at a rate of $18,000 for a full page, that means they earn $540,000 per issue from advertising. It’s fair for me to be appropriately compensated for my contribution. In the circumstance of a corporate/commercial shoot, I am directly contributing to the sale of their product or the public perception of their company, and, again, compensation commensurate with their benefit is appropriate.

As a freelancer, the notion that these companies want to own the copyright, feel they deserve the copyright, feel they are entitled to it, or take the attitude that “I paid for it, so I own it” shows ignorance about the intent of the framers of the Constitution and the law today. Let's take a look at an example. If, when driving through New York City, a Californian comes to a stop at a stoplight, and then makes a right on red, that driver will get a ticket. You can’t expect that your explanation to the issuing officer (“But officer, I didn’t know I couldn’t do that!”) will mean you don’t get or don’t deserve the ticket. Further, an infrequent Manhattan driver in Manhattan might make the same claim.

Someone who has never licensed photography is similar to the aforementioned California driver in Manhattan. For the driver, there may be some room to get a warning ticket. For the photographer, he may be afforded an explanation by a copyright owner about how he can and can’t use the work created.

In the case of the infrequent Manhattan driver, he lives in New York City and is obligated to know his city’s driving rules—just as the ad agency or publishing conglomerate must know about the rules of copyright and the consequences for an infringement.

To give you an understanding about just how much the founders of the United States valued the concept of copyright, consider this. The Constitution begins “We the People,” and the first section—the first—stipulates what legislative powers are held by the Congress, as well as who can be a member of Congress and who can be a Senator. In Section 8, the Constitution stipulates that Congress shall:

This limited exclusive right is the basis for US copyright. At the end of the chapter, I'll include suggested books that go into detail on how the US copyright is based upon English law. These books are excellent resources to understand the birth of copyright. This exclusive right delineation comes before a discussion of who can be the president and how. It comes before the rules and obligations of the states. Further, it comes before Constitutional corrections—things they forgot about or were wrong about and needed to fix or add—the Bill of Rights, ending slavery, the right to bear arms, and such, which became the various amendments to the Constitution. I say this because I hear all too often how copyright is not important to some photographers, and that they don’t really care or enforce their copyright.

Just as I get incensed over violations of a citizen’s civil rights or prejudice against race or sex, I get angry on principle when people infringe on my right, given to me at the same time as senators and representatives, and before the president, and before the states, and before the right to bear arms, and before the numerous other amendments. The framers, hundreds of years ago, and throughout time since, have recognized the value of “useful arts” and sought within the first 1,600 words of a document that, without amendments, is approximately 4,500 words in length. When I hear a fellow artist say, “Oh, I really don’t care about copyright,” I find that offensive. I think that if “copyright” were to be substituted for “the right to keep and bear arms” or “the abolition of slavery” or “equal rights for men and women,” almost everyone else would be offended by the artist's statement of disinterest. Yet it was these rights that were parts of the Bill of Rights—that were amendments to the constitution. The basis for copyright was not an amendment; it was in the beginning of the Constitution. So I encourage anyone who "doesn’t care" about copyright, who is willing to sell it for a minute fraction of what it’s worth, or who looks at someone who is enthusiastic about protecting their own copyright with disdain to rethink their own principles and perspective. Yes, I believe in copyright laws, and you should too!

Don’t Steal My Work, Period

With the position I’ve described, I’ve found myself in several situations in which my work has been infringed. Stolen is a better word, but infringed is the technical term. To that end, use the term in dialogues when you’re infringed. To that point, your work will be infringed. If you’re displaying it, sharing it, or otherwise distributing it, I can practically guarantee that you will be infringed upon. If I told you that I could provide the same guarantee that you would have someone break into your house, would you buy an alarm? How about a guarantee that you’d have an auto accident at some point in your life—would you get insurance? I suppose the answer is the same in both cases. Trust me—you will have your work infringed. To that end, protect yourself.

That said, if you’re unhappy about Adobe’s requiring you to activate your software, thank the thieves. In an April 2005 interview with the San Francisco Chronicle, Adobe CEO Bruce Chizen reports that one third of their revenue is lost to software thieves. I encourage you to learn more about piracy in general at sites such as www.bsa.org/usa/antipiracy, because piracy of software has similar arguments and issues as infringement in photography.

The software fotoQuote, with was the precursor to fotoBiz, was almost put out of business because photographers were stealing the software. Photographers steal Photoshop. They steal FTP software—even software that costs less than $40 is being infringed. I cannot see my way clear to demand one cent from someone else who has stolen my work if I were infringing upon others' creative endeavors, whether software, movies, music, or the like. Further, if I can’t afford something so absolutely integral to my business as Photoshop, then there are significant problems with my revenue totals—so much so that I can’t afford an initial $600 and upgrades of $200 or so every 18 months for something I use for extended periods of time almost every day. Further, it is important to note that Adobe, as a normal part of their file handling process, generates a unique document ID for every image it handles for you. This generated ID is unique to you—or more specifically, your registered version of Photoshop—because it integrates the serial number of the program into the ID. And, as any program evolves, you can expect this handling of your files and the legality (or lack thereof) of your installed version of Photoshop (as well as other applications) to be a growing issue as all software companies seek to combat piracy, just as you would like as many tools as possible to protect you from people stealing your photography.

Copyright: What Is It, When Is It in Effect, and Whose Is It?

Copyright is exactly that—the “right to copy.” And, it includes the converse—“the right to preclude a copy.” Copyright is also, as noted above, the right to display (that is, present—or not—in a gallery, on a Web site, and so on); the right to perform and the converse (prevent a performance of), which is not as prevalent an issue for photographs; the right to distribute or opt not to allow distribution; and a variation of the right to copy—that is, make a derivative (or, again, to preclude someone else from doing so). For photographers, producing work now causes your work to be copyrighted the moment the shutter closes and the image is fixed in a Flash card chip (or on film if you’re still so inclined). Were someone to steal that card and publish your work, you are protected—not as well as if you’d registered the work, but you’re protected because you’ve been infringed. All you’d have to do is secure the file, compare the metadata that includes the camera’s serial number in it, and then sue not just for infringement in federal court, but also for theft of physical property in civil court.

Registering your works gives a greater extent of protection, and there are multiple books that go into great detail as to what the differences are between registered and unregistered work, so I will not endeavor to detail that in this book. I will simply state that you should register your work.

Although it might seem obvious, it’s worth repeating: In almost all cases, unless you signed a “work made for hire” document before the work was completed and fell into one (or more) of the nine categories previously enumerated in Chapter 5, as well as all the other conditions, the work is owned by you. If you instead signed a document that stipulated copyright transfer, then your work is not owned by you. If you are an employee of a company as a photographer, then the work you do for them on assignment is theirs, regardless of whether you signed or didn’t sign anything. However, this book is geared more toward the freelance photographer (or the staffer who freelances on the side or wants to leave their employment for the freelance world).

How do you establish your prices? This is seemingly an age-old question, and certainly one that perplexes many of the more experienced photographers, who, when asked, simply shrug their shoulders and respond with something like, “I sort of just guesstimated.”

If this is you, don’t be alarmed—you’re not alone. That doesn’t mean you’re free and clear; it means you need to reverse-engineer your rates to see whether what you’ve been doing meets your long-term goals. You also need to know which types of assignments are revenue positive and which may be, without your even knowing, revenue negative (yes, that means taking a loss on a job).

Although 10 years ago resources were few and far between to help you come to reasonable and logical conclusions about rates, they are abundantly available now in books, online, and in software specially designed for photographers.

First things first, though. Repeat the following phrase out loud three times. If you’re reading this in midair while flying over country, say it anyway. If you’re reading by bedside light and your significant other is asleep, say it anyway. But if you’re in a church, then[el]wait. Why are you reading this book in church? Anyway, say this:

“I am a profitable business and must remain so. If I am not, I’ll be waiting tables soon.”

“I am a profitable business and must remain so. If I am not, I’ll be waiting tables soon.”

“I am a profitable business and must remain so. If I am not, I’ll be waiting tables soon.”

Now, no disrespect to wait staffs all across the country, but I doubt very many of them aspire to be wait staff for the rest of their lives. For most, it’s a waypoint during college, while they wait to be discovered and become a famous actor, or perhaps someday own the restaurant. Regardless of their goals, yours is to remain a photographer.

Second, in keeping with the mentality of the mechanic who repaired your car in five minutes (as related in a previous chapter), the amount of time involved in the shoot is a relatively small factor in determining your rate. In fact, your fees could well be increased conversely to your ability to execute the shoot expeditiously, and thus you should earn a premium. Nowhere else that I know of does someone more skilled get paid less because they completed their tasks faster than another less-experienced person.

Taking the approach that being the lowest-priced photographer will earn you all the work you need is a failing goal. The commoditized photographer promotes himself first on price, then on service or style of photography, and then finally on himself.

The best photographer is one who promotes and markets first himself, second his services and style, and finally, his price.

Of course, before you charge a profitable rate, you’ll need to have a clear understanding of what is required to be in business. Even if you’ve been in business for years, you may have been allowing your personal expenses to subsidize your business, and as such, you might have been in the dark about what it truly costs to be in business. Now, you’ll need to change that to get a handle on your business and move it forward.

There are a few “cost of doing business” calculators online. One that I contributed to (no bias here!) is the National Press Photographer’s Association CODB calculator, which can be found under the Professional Development > Business Practices section of http://nppa.org. Look for the NPPA’s Cost of Doing Business Calculator link. An interactive calculator, it pre-populates the form with reasonable numbers for all the categories. In addition, when clicked, a circled “i” next to each category will give extensive information about that category (see Figure 5.1).

After you’ve determined your CODB, it’s time to compare that to what you’re charging for what are typically referred to as “photo fees” on many generic invoices. These are a separate line item from all the expense lines.

Suppose you have an editorial assignment for which you are charging $1,200 plus expenses, and, using the NPPA’s default figures for their CODB calculator, your business costs $898.50 per day of shooting. This means that the difference between what you are charging and what your CODB is—$301.50—is either a profit for the business, a usage fee for the use of the images, or some combination thereof. Typically, in this line item of $1,200, you’ve rolled in your CODB costs as well as usage. There is, however, a school of thought that suggests those two items should be separate, and both sides of the debate are passionate about the issue amongst photographers.

I’ll present the two schools of thought as fairly as I can regarding photo fees. Before moving to that, though, it is important to consider whether what you are paying yourself is going to be a fixed cost within the CODB calculation or a percentage of profits. I would submit that you should determine a fair wage and include that figure as a fixed cost, and one that increases annually—not only by approximately 5% for standard cost-of-living-adjustments (COLAs), but also commensurate with your growth and increased experience as a photographer. A 5% annual COLA and a 10% increase every two years would be more than reasonable.

The following sections discuss two schools of thought regarding photo fees.

School of Thought #1: All Creative/Usage Fees Are Listed as a Single Line Item

Many photographers simply put both CODB costs and usage fees together. Typically, they do so because they don’t want to separate the two or they don't have a solid grasp of how to best separate the two. (Or perhaps they don’t know their CODB.) Thus, many photographers list both items as a single line item because they don’t want to get into unknown territory. They do what they’ve done before, which has seemed to work so far.

One argument for keeping them together is that this is the way software companies handle it, and that’s a fair comparison. When I purchase my license to use Photoshop, I am obtaining, at nominal expense, the materials (CD, manual, and so on), and at a larger expense, the license to use the software on one desktop (and one laptop, according to the last EULA I read). If, after buying the software, I learn it’s not Universal Binary, but rather must run under emulation, I opt not to even peel the wrapper off the box. (This is a Mac issue, so you PC users need not worry about this (yet), but it’s an understandable analogy, so go with it.) I continue to run the previous version under emulation, because all the online reviews say it’s better. I then call the creator (Adobe) and say I’ve opted not to exercise my licensed rights, and, therefore, would like to not be charged (or get a refund) for the license.

The argument is that the license is included in the fee because, whether or not you’ve exercised your right to use the photo, you contracted for that fee and are obligated to pay it. Were there to be line items of, say, $1,800 for creative fees and $12,000 for usage fees, if the client specified that they killed the project or the usage is being scaled back to a figure for which you would have quoted a $2,000 usage fee, there is a valid argument as to why they should be paying the lower fee if it’s broken down.

Another argument is that clients often come back to photographers for additional uses or to extend the existing rights package to include another six months (or longer), and if you’re figuring this based upon the larger creative+usage fee, then the end result is a higher additional fee for the added or extended uses.

School of Thought #2: There Should Be Separate Line Items for Creative and Usage Fees

Some photographers break these fees out, often at the request of clients trying, as they’ve said to me on more than one occasion, “to compare apples to apples.” This means that other photographers are regularly separating the two. In addition, the client can understand that you’re not earning $13,800 for the day, but $1,800 for the day, and then the $12,000 is for X period of time, during which the client can exploit the work to serve their company’s interests. This often makes for a better understanding of the fees outlined on an estimate—something that must be justified to the end client. Even when the bottom-line total is the same, details such as a separation can make a difference.

A downside that becomes obvious when you apply the math from #1 is that if you’re basing your quoted fees for additional or extended uses on the original figure, subtracting $1,800 will reduce your additional fees when you are coming up with a percentage-based rights extension. The upside, though, is that clients understand the percentage better when they see how you arrived at the original, and now expanded, fees.

After you’ve figured out whether usage is a part of creative, then figure out your fees. As a baseline, take your CODB add 7 to 15 percent as a profit for the business, and consider that as what you charge for an assignment for which you remain in "first gear" (if you’re a five-speed manual) and for which little of your extensive skills or creativity are called for. With a CODB of $900, that’s a $990 creative fee (which includes a 10% profit for the business).

For assignments that require a bit more effort and creativity, consider a percentage-based increase in your creative fee—say 30 percent to hit “second gear,” for $1,200. For assignments that require you to get moving (and creatively interesting), you bump to "third gear"—say a 50-percent increase, or $1,350. For assignments that are creatively exciting, you hit “fourth gear” at a 75-percent increase over your CODB, or $1,575. For assignments that are creatively challenging and taxing (and exciting), you could end up at 100 percent of your CODB, or $1,800.

On top of all this is usage. With all the resources available to you via software and online sites, you can determine usage guidelines (and modifying factors) fairly easily after you review the available historical surveys, more recent surveys, and, in some instances, factors of a media buy. Following the review, you'll have a good idea what to add for usage.

A model that has been discussed and debated, and one that I feel is not only fair, but also comprehensible by clients—especially those who are art buyers—is a percentage-based model. I first came across this concept during a panel discussion at a conference where primarily advertising photographers were speaking, and the concept struck a chord with me. Usage, it was suggested, should be based upon a percentage of the media buy, and there are photographers who are having success with this usage pricing model. In many instances, however, usage is limited by the photographer to a specific state, region, ad type (bus backs, billboards, movie theater pre-show screens, and so on), and time frame, so without knowing the media buy, you are setting a price that will delineate the usage to such an extent that your usage fee set forth is akin to knowing the actual media buy. However, there might be uses within your description that you’d not thought of, and the client may be exploiting the right to employ images for those uses.

In addition, media buys can be a moving target. The initially stated buy could be midsized, so you estimate for that, and then it when/if it’s reduced (sometimes significantly), your percentage total must go down. Perhaps you’ll have a minimum buy, or perhaps you have a sliding scale.

Almost all advertising agencies are paid a commission based upon the media buy, and the commission ranges from 10 to 15 percent. However, for extensive multimillion-dollar buys, agencies have been known to accept commissions as low as three percent. This approach of a sliding scale makes a great deal of sense. Although some art buyers may state that they don’t know what the media buy is (and that may be the case), more than likely many just do not want to disclose to you the media buy.

Here are a few ranges and percentages that would be fair and appropriate to apply, and would take into consideration the value of the usage:

[lb] $2MM or greater: 3%

[lb] $1.5MM to $2MM: 4%

[lb] $1MM to $1.5MM: 4.5%

[lb] $600k to $1MM: 5%

[lb] $450k to $599k: 5.5%

[lb] Less than $450k: 6%

There are, however, a few caveats to this list. If it’s a full-page ad with a heroic photo that’s not yours, and yours is a quarter-page inset photo, then your percentage should then be adjusted downward. If it’s all your photos in the ad, even multiple photos taken at different shoots, you would have been paid for each of the shoots, but the usage fees would be a single sum combining them all. If nothing else, in the end, you can do the research and find that a full-page ad in a trade magazine with a circulation of 30,000 costs $8,000, and if they want unlimited rights to advertise in all trade magazines for two years, that’s 24 months times $8,000, times four or so magazines, or $768,000 in possible media buys. In this case, a five-percent usage fee is $38,400. Of course, this would be the likely maximum media buy they could make under those rights, but this certainly gives you a starting point to quote from for usage; moreover, you can negotiate downward for the total and the expanse of usage. A percentage such as this is often something that clients can not only get their heads around, but also can accurately and in simple terms convey to their own clients.

At the conclusion of your determination of how much you’ll have to put into delivering the best images to meet client needs and usage, you can combine them or not, consistent with your decision about the aforementioned factors involved in delivering a clear and understandable estimate for the client's consideration.

Raising Your Rates: Achieving the Seemingly Impossible

No matter what rate structure and fees you’ve decided are right for you, ultimately you’ll need to (and want to) raise your rates. The federal government gives its employees a cost-of-living adjustment (COLA) each year, as do most corporations across the country—or at least they used to! This is done for purely economic reasons. If a loaf of bread cost $1.29 last year, this year it costs $1.35, and the government wants to take this into consideration. Otherwise, over time, you wouldn’t be able to afford the same grocery needs that you had, say, five years ago. If for no other reason than “everyone else is doing it,” your rates should increase over time. If they don’t, everyone but you will have more buying power, and you’ll be at a disadvantage. The car that cost $20k ten years ago now costs $27k, and you can no longer afford it—among other things.

Understand, though, that the COLA does not take into consideration promotions and raises that everyone else is striving for in their jobs. You too should strive to earn more as an employee of your business than you did last year. How much is up to you. Ten percent? Fifteen percent? Did you do a bang-up job for the business, working extra hours and weekends, outperforming last year? If so, a promotion of 20 or 25 percent is what others are achieving. Yet how do you do this when you are both the raise seeker and the raise approver, as well as the justifier to the customer of the new rates? It’s a huge challenge.

Consider the scenario in which you have based your rates and fees on time—typically covering luncheons, dinners, galas, or even rites of passage. I adjusted my rates somewhat quietly. Early in my career, I had a four-hour minimum and was charging $100 an hour—in other words, a $400 minimum—but for that, the client could book me for up to four hours. After a few years, I raised my rates to $125 an hour, reduced my minimum to three hours, and added an administrative fee that was 10 percent of the estimate total—usually around $48 or so. This meant that the combined photo fees and administrative fee was $375 + $48, or about $423. In addition, for the clients who did need me for four hours (or booked me for three, then ran over), I was able to bill an additional $125, so my four-hour assignments were bringing in $500, and no one was

complaining. In addition, this eliminated situations in which clients figured out that it was the same to have me arrive at 8:00 am for a 10:00 am event concluding at noon as it was for me to arrive at 9:30. Not only did this save me the headache of fighting rush hour traffic and getting up early (one of my least desirable things to do), but I was able to take assignments that ended, say, at 5:00 pm and move on to assignments that were from 6:00 pm until 9:00 pm. Previous clients were having me arrive at 5:00—something that I couldn’t do, and thus had to lose one job or another.

A few years ago, I decided I was busier than I expected, and I thought I might be able to weed out a few clients if I raised my rates again, so I did. I increased them to $150 an hour, with the same three-hour minimum, and the administrative fee jumped to around $68, meaning that a three-hour event earned $450 + $68, or $518, and that four-hour event was earning $600 + $75 (approximately) in administrative fees, or $675. This was a decent increase over the original $400 of a decade earlier. Is almost a 60-percent increase over, say, 10 years. Good? Perhaps. Does it take into consideration a COLA? Yes. Did it award me raises and promotions because I am more competent than I was 10 years ago? Maybe.

Other downward pressures are more demands for “all rights,” “buyouts,” work-for-hire (more on these later in this chapter), hobbyist photographers who claim to be working photographers capable of filling client needs, and market forces in my community. In the coming year, I am looking to increase my rates again because that previous bump from $125 to $150 didn’t cause the reduction in assignment-load I had expected.

In the scenario with rates based mostly on creative and not so much on time—often editorial assignments or corporate/commercial/advertising work—how I adjusted my rates did not occur with any more fanfare than necessary. Many of my clients, although repeat clients, are accustomed to receiving estimates before each assignment, so increases were less perceptible, and I certainly maximized my ability to increase my rates during the transition to digital. This not only covered the costs of the transition, but an increase in overall profitability per assignment. Magazine assignments that used to be $750 including expenses are now in the $1300 to $1500 range.

Of course, it’s imperative that you (internally) have an hourly rate that you use and apply to your calculations to arrive at your rates as a baseline for services rendered, from photographic to post-production and such. This is not an external figure that you share with clients; rather, it's a figure that helps ensure that you are paid that fixed salary from the CODB calculator.

Surveying Your Competition: How to Gather Knowledge without Risking a Price-Fixing Charge

One of the ongoing issues among professional trade associations is that they cannot endorse, encourage discussion about, or advise a particular set of rates.

Law.com provides the following definition of price fixing:

n. a criminal violation of federal antitrust statutes in which several competing businesses reach a secret agreement (conspiracy) to set prices for their products to prevent real competition and keep the public from benefiting from price competition. Price fixing also includes secret setting of favorable prices between suppliers and favored manufacturers or distributors to beat the competition.

Discussing with your colleagues and competitors what prices they charge (or would charge) for a particular assignment or type of assignment is not price fixing. If you agree to charge a set price and are among “several” (as noted above) companies that “prevents real competition,” then you have a problem. However, many trade associations have worked diligently to avoid even the appearance of a price-fixing charge—an understandable measure of self-preservation, because no one wants to be the subject of a Federal Trade Commission probe. Back in the 1980s, ASMP produced a well thought-out survey of its membership as to the prices they charged (and presumably would charge in the future) for their services. Despite this well-intentioned work product, the Federal Government took a dim view of this and expressed as much to the ASMP in no uncertain terms. This has caused a chilling effect regarding pricing information and how (and by what means) it is shared. However, this should not discourage you from appropriately reaching out to others about pricing you may be less than familiar with.

Perhaps your reason for inquiry is that although you can produce the final product you’re being asked to, you might not be familiar with all that goes into it. Suppose its aerial photography, and you don’t know the risks to life, delays in weather, and pre-production and post-production demands that go into the final product. A call to an aerial photographer—quite possibly one far outside your market—could yield insights that would give you the knowledge necessary to prepare a proper estimate and equipment rental needs, so that you’re not selling yourself short and you don't end up taking a loss on an assignment because of all the non-behind-the-camera work involved.

Perhaps your reason for inquiry is you are new to a market, and your “big city” pricing is turning off many of your clients. You are capable of doing the work in this new-to-you midsized town because you were booked often in your old location, so perhaps a review of your competition’s pricing will cause you to reevaluate your pricing. It’s not much different than a gas station owner coming to his corner of an intersection and seeing that his competitors on the other three corners have dropped their prices by 33 cents a gallon. He’s going to be making some adjustments to his pricing signage post haste, or risk going out of business.

If, when you reach out to others, they are reticent about sharing their prices with you, don’t instead have a friend call up and try to book several assignment types from each photographer. That’s unethical and dishonest to be sure. Instead, share with the photographers in question that you are hoping to get a fair gauge of the marketplace, and you may not recognize all that is necessary to deliver to clients in that town. Discuss the fact that you may be setting yourself up to over-deliver, and thus over-price, say, raw files, and not charge any post-production fees, which would make you under-priced and under-delivering to the marketplace’s expectations.

I have found that my Web site, which contains hundreds of pages of pricing information and an assignment calculator to aid clients in pricing an assignment before they call, is often used by my potential competition both locally and across the country to price their own assignments. This doesn’t bother me—in fact, I am happy to know that it’s happening. If someone independent of me opts to calculate what I’d charge for an assignment and values their work as I do, then if we both are competing for the same job (and I have no way of knowing whether this is occurring), we will be competing on the level of service, creativity, and quality, not on price.

Never Be the Cheapest

It’s true. You never want to be the cheapest. I don’t want to be the “always low prices, always” Wal-Mart version of photography. Nor do I want to be the Target version. I want to be the Nordstrom, Saks, Tiffany, or other high-end-exclusive boutique version of photography. Further, I believe that’s the level of service, quality, and commitment I bring to each assignment.

When I am discussing an assignment with prospective clients, they give off cues that they are going to be getting estimates from other photographers, and usually there is a hint of “we’re looking at a few photographers' estimates right now” that gives me a clue that they’re shopping price, among other things. At this point in the conversation, I attempt to diffuse the price-shopping by stating, “If you’re shopping price, I can pretty much assure you that I am not going to be the cheapest, but I will deliver the quality that you (or your client) demand, at a fair price.” Sometimes they are taken aback, but if you see that cost comparison down the road, you’ll likely lose the assignment anyway, unless the client sees the value you bring. It's beneficial for you to point this out to the client sooner rather than later, and perhaps the other person on the phone—who often isn’t the decision maker—will go to bat for you, and you’ll get the assignment.

If You're the Cheapest, Find out What Is Wrong

If you’re the cheapest—and finding this out isn’t too difficult—you want to know why. Perhaps it was in the expenses area of your estimate because you didn’t include catering in a shoot that didn’t call for it, or a second assistant when the shoot only called for one. Or perhaps it was because you used ambiguous licensing terms that gave away more than you intended without your being paid the correct fees for the assignment.

When on assignment with clients, I often will discreetly survey them about how I came to be their photographer of choice. To date, I’ve not had a client state that it was due to price; I am aware that I am not the least expensive photographer in my community. Typically, I am a sole-source contractor who came to them by a recommendation, or a review of my Web site gave them the confidence to book me. If, however, it was because I was the cheapest, I’d ask a few more questions. Perhaps there was a misunderstanding about rights, rush turnarounds, or what was included in the assignment expectations. Either way, asking appropriate questions can give you insight into what you might not have (but should have) factored into the assignment
